These Terms and Conditions ("Terms") govern your use of condotaxappeals.com (the "Site") and the services offered by CondoTaxAppeals.com, LLC ("CondoTaxAppeals," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Our Services

CondoTaxAppeals is a property tax appeal service platform that assists Florida condominium associations and their unit owners in seeking reductions of ad valorem property tax assessments. We coordinate the group appeal process, including analysis, filing, and negotiation with the relevant county authorities, and representation before the Value Adjustment Board where appropriate.

2. Not a Law Firm; No Attorney-Client Relationship

Important. CondoTaxAppeals.com is not a law firm. Seth D. Lubin, Esq. serves solely as General Counsel to CondoTaxAppeals.com and does not represent any condominium association, board member, or unit owner individually. No attorney-client relationship is formed between Mr. Lubin and any client, association, board member, or unit owner as a result of services provided through this platform, and use of this Site does not create an attorney-client relationship.

3. No Legal or Tax Advice

The content on the Site is provided for general informational purposes only and does not constitute legal, tax, financial, or other professional advice. You should consult your own qualified professional regarding your specific situation. We make no representation that the information on the Site is complete, current, or applicable to your circumstances.

4. No Guarantee of Results

Property tax appeal outcomes depend on facts and circumstances specific to each building and unit, and on the decisions of county officials and the Value Adjustment Board. Prior results described on the Site do not guarantee or predict a similar outcome in any other matter. We do not promise that any appeal will result in a reduced assessment or tax savings.

5. Engagement and Fees

The free analysis described on the Site does not, by itself, create a contractual engagement. Any engagement of our services is governed by a separate written agreement between CondoTaxAppeals and the association, which controls in the event of any conflict with these Terms. Our services are generally provided on a contingency basis, meaning a fee equal to a stated percentage of tax savings achieved applies only if a reduction is obtained. Specific fee terms are set out in the applicable engagement agreement.

6. Eligibility and Authority

By submitting a request, you represent that you are at least 18 years old and that, if you are acting on behalf of an association or another person, you are authorized to do so. You agree that the information you provide is accurate and that you will keep it current.

7. Your Responsibilities

You agree to use the Site only for lawful purposes and not to: interfere with or disrupt the Site or its security; attempt to gain unauthorized access to any systems; submit false, misleading, or fraudulent information; or use the Site in any way that violates applicable law.

8. Communications Consent

By providing your telephone number or email address, you consent to receive communications from CondoTaxAppeals related to your inquiry and our services, including by email, telephone call, and text message, which may be sent using automated technology. Consent is not a condition of any purchase. Message and data rates may apply. You may opt out of marketing emails using the unsubscribe link in any message, and you may opt out of text messages by replying STOP. We will continue to send communications necessary to provide services you have requested.

9. Intellectual Property

The Site and its content, including text, graphics, logos, and design, are owned by or licensed to CondoTaxAppeals and are protected by intellectual property laws. CondoTaxAppeals and related marks are trademarks or service marks of CondoTaxAppeals.com, LLC. You may not copy, reproduce, distribute, or create derivative works from the Site without our prior written permission.

10. Third-Party Services and Links

The Site may include links to or integrations with third-party websites and services. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party services is subject to their terms.

11. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, CondoTaxAppeals and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless CondoTaxAppeals and its members, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site or your violation of these Terms.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the revised Terms on this page. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

16. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and any applicable engagement agreement, constitute the entire agreement between you and CondoTaxAppeals regarding the Site.
